These Terms govern your use of freediving.studio (the "Service") — a web and mobile application for logging, analysing and sharing freediving activity, and for creating videos of your dives. The Service is operated by Pixelated Limited, a company registered in England and Wales ("we", "us", "our"). By creating an account or using the Service you agree to these Terms. Please read them carefully, especially the safety notice below.

⚠️ Important safety notice — read this first

Freediving and breath-hold activities are intrinsically dangerous and can result in blackout, injury or death. The Service is an informational and record-keeping tool only. It is not a dive computer, a safety device, a medical device, or a substitute for proper training, supervision or medical advice.

You use the Service, and undertake any freediving activity, entirely at your own risk.

1. Eligibility & your account

You must be at least 16 years old (or the age of digital consent in your country, if higher) to use the Service. You are responsible for the security of your account and for all activity that occurs under it. You can sign in with Apple or Google; you must comply with their terms when authenticating.

2. Acceptable use

You agree not to: use the Service unlawfully; upload content you do not have the right to upload; infringe anyone's rights; attempt to access another user's data; reverse engineer, scrape, or disrupt the Service; or use it to harass others or share content that is illegal, harmful or abusive. We may remove content or restrict access that breaches these Terms.

3. The Service & no warranties

The Service is provided "as is" and "as available". We do not warrant that it will be uninterrupted, error-free, secure, or that any data, calculation, chart or analysis it produces is accurate or complete. Dive metrics (including depth, speed, temperature, heart rate, discipline detection and derived figures) are provided for informational purposes only and may contain errors. We may change, suspend or discontinue any part of the Service at any time.

4. AI features

The Service includes automated analysis and an "AI coach" that generate suggestions and summaries about your dives, in part using third-party AI models. This output is generated automatically, may be inaccurate or misleading, and is not professional coaching, training, safety or medical advice. Do not rely on it. You are responsible for how you use any information the Service provides.

5. Your content

You retain ownership of the dives, videos, notes, images and other content you add ("Your Content"). You grant us a limited, worldwide, royalty-free licence to host, store, process and display Your Content solely to operate and provide the Service to you (for example, to store your dives, render your videos on your device, or share a dive with a coach you choose). Video rendering happens on your device; we do not upload your raw video footage to our servers. You are responsible for ensuring you have the rights to any content you upload and for keeping your own backups.

6. Freediving.studio PRO subscription

The Service offers a free tier and a paid subscription, Freediving.studio PRO ("PRO"). PRO unlocks features such as unlimited AI-coach analyses, full-length video export without a watermark, unlimited dive history and coach sharing. Features and limits may change over time.

7. Cancellations & refunds

If you are a consumer in the UK or EU, you have a statutory right to cancel a purchase within 14 days. However, because PRO is digital content supplied immediately, by subscribing and accessing PRO features you may agree to begin the service immediately and acknowledge that your right to cancel may be lost once the service has started, to the extent permitted by law. Purchases made through the Apple App Store or Google Play are subject to those stores' refund policies, and refunds for them must be requested from Apple or Google. Except where required by law, payments are non-refundable.

8. Referral programme

We may offer a referral programme that awards credits when people you refer subscribe to and remain on PRO. Credits, their value, qualifying conditions (including any minimum subscription period), redemption and any cash-out are described in the app and may be changed or withdrawn at any time. Credits have no cash value except where we expressly offer a cash-out, are non-transferable, and may be forfeited if we reasonably believe the programme is being abused (for example, through fake or self-referrals). Any cash-out is subject to identity and tax requirements and applicable law.

9. Intellectual property

The Service, including its software, design, branding, wordmark and content (other than Your Content), is owned by us or our licensors and is protected by intellectual-property laws. You may not copy, modify, distribute or create derivative works from it except as expressly permitted.

10. Third-party services

The Service relies on third parties including Supabase (data & authentication), Google (sign-in and AI), Stripe and RevenueCat (payments and subscriptions), and Apple / Google (app-store distribution and billing). Your use of those services through the Service is also subject to their terms and privacy policies. We are not responsible for third-party services.

11. Suspension & termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you breach these Terms or if we reasonably need to for legal, security or operational reasons. On termination, your right to use the Service ends; sections that by their nature should survive (including ownership, disclaimers, limitation of liability and indemnity) will continue to apply.

12. Limitation of liability

Nothing in these Terms limits liability that cannot be limited by law (including liability for death or personal injury caused by our negligence, or for fraud). Subject to that:

You agree to indemnify us against claims, losses and costs arising from your breach of these Terms, your misuse of the Service, or content you upload.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes we will take reasonable steps to notify you (for example, in the app). Changes take effect when posted, and your continued use of the Service means you accept them.

15. Governing law

These Terms are governed by the laws of England and Wales, and disputes are subject to the exclusive jurisdiction of the courts of England and Wales, unless mandatory consumer-protection law in your country of residence provides otherwise.
